Jammu and Kashmir as a Union Territory: Lieutenant Governor, Assembly and Statehood
Why in news: J&K's five ministers handed resignations to their party on 26 October 2026, ahead of a Council reshuffle set for 27 October.

The Jammu and Kashmir Reorganisation Act, 2019 made Jammu and Kashmir a Union Territory with a legislature from 31 October 2019. Elected ministers advise its Lieutenant Governor, who acts in his discretion on police, public order and All India Services. A Cabinet reshuffle was set for 27 October 2026; the Congress stayed out over Union Territory status.
Syllabus: GS2 · Constitution; GS2 · Federalism & Local Government; Prelims · Polity & Governance
Why this matters for UPSC
GS2 polity and federalism: Union Territories under Article 239 and Article 239A, the Lieutenant Governor's discretion and Statehood under Article 3. Prelims can ask who appoints J&K's Chief Minister or the ministerial cap; Mains, about elected government in a Union Territory.
In short
Jammu and Kashmir is a Union Territory with a legislature under the Jammu and Kashmir Reorganisation Act, 2019; its elected government shares power with a President-appointed Lieutenant Governor (LG).
Restoring Statehood is Parliament's call under Article 3; until then, clear rules on the LG's discretion must keep elected ministers answerable for governance.
Why it matters
A voter in Jammu and Kashmir elects a legislator and a government, but that government cannot direct the police or decide public order. Senior officers' postings pass through a Lieutenant Governor chosen by the President. When a crime wave or a protest breaks out, the minister answerable in the Assembly cannot order the response; the LG can. That splits responsibility: voters can punish ministers at the polls, but not the office holding the key levers. Coalition politics bends around the same fact, as allies weigh whether joining a government with limited powers is worth it. The larger issue is federalism: whether a State's status, once taken away, returns on a fixed path or rests on the Union's choice of timing.
Prelims pointers
- Article 239A, inserted by the Constitution (Fourteenth Amendment) Act, 1962, now names Puducherry alone; section 13 of the 2019 Act applies it to Jammu and Kashmir.
- Article 246(4) lets Parliament legislate on State List matters for any area not in a State; section 32(2) keeps that power intact for J&K.
- J&K's Ministers hold office during the LG's pleasure but are collectively responsible to the Assembly; a non-member Minister goes after six consecutive months (section 54).
- Ladakh, made of Kargil and Leh districts, is a Union Territory without a legislature (section 3); section 57 abolished the former State's Legislative Council.
- Section 73 of the 2019 Act lets the President suspend any of its provisions if J&K cannot be administered under it, or if necessary or expedient for proper administration.
- In Re: Article 370 of the Constitution (2023) left open whether Parliament may convert a whole State into Union Territories under Article 3.
Practise a UPSC-style question
With reference to the Legislative Assembly of the Union territory of Jammu and Kashmir, consider the following statements:
1. It cannot make laws on "Public Order" and "Police", entries 1 and 2 of the State List.
2. A Bill imposing a tax may be introduced in it without the Lieutenant Governor's recommendation.
3. The Jammu and Kashmir Reorganisation Act, 2019 abolished the former State's Legislative Council, leaving a single-House legislature.
Which of the statements given above is/are correct?
- (a) 1 and 2 only
- (b) 2 and 3 only
- (c) 1 and 3 only
- (d) 1, 2 and 3
Show the answer
Answer: (c) 1 and 3 only
Answer: (c) 1 and 3 only. Statements 1 and 3 restate sections 32 and 57 of the 2019 Act; statement 2 reverses section 36.
Statement 1: correct. Section 32(1) lets the Assembly legislate on State List matters except entries 1 and 2, "Public Order" and "Police".
Statement 2: incorrect. Section 36(1) bars introducing a Bill on the imposition or alteration of any tax without the Lieutenant Governor's recommendation.
Statement 3: correct. Section 57 abolished the former State's Legislative Council from the appointed day; the Union territory has only a Legislative Assembly.
Eliminate: statement 2 is wrong, since tax Bills need the Lieutenant Governor's recommendation first. Out: (a), (b), (d).
Trap: Sounds right. Statement 2 lends tax Bills the freedom of ordinary Bills, though section 36 puts the Lieutenant Governor's recommendation before introduction.
Remember: J&K's Assembly: no laws on police or public order, no tax Bill without the LG's recommendation, and a single House.
