UN Commission of Inquiry finds genocidal acts in Gaza continued after ceasefire

A UN Commission of Inquiry's fifth report, presented at the UN General Assembly, finds that Israeli forces kept committing genocidal acts in Gaza after the October 2025 ceasefire. It also finds crimes against humanity, including extermination and torture, in the West Bank. Its Chair addressed the UN on 26 October 2026, and Israel's envoy rejected the findings.

Why this matters for UPSC
GS2 international institutions: the Human Rights Council, the ICJ, the ICC and the Genocide Convention. Prelims can ask who sets up such commissions; Mains, their limits.
Why it matters
For a Palestinian family in Gaza or a West Bank refugee camp, a ceasefire on paper has not meant safety, the Commission says. Its finding that genocide continues matters beyond the region. Every State that has accepted the Genocide Convention carries a duty to prevent and punish the crime, so the report presses governments to review the military and economic help they give. The evidence it has preserved can be passed to courts that do have power to rule. The episode also shows the limits of UN human rights machinery: a commission can name crimes, but it cannot enter territory without consent or force anyone to act.
Prelims pointers
- The UN General Assembly adopted the Genocide Convention on 9 December 1948; it entered into force on 12 January 1951 after twenty ratifications.
- Article II of the Genocide Convention protects four groups: national, ethnic, racial and religious. It lists five punishable acts.
- The ICJ has 15 judges, elected for nine-year terms by the UN General Assembly and the Security Council; it is the only principal UN organ outside New York.
- The ICJ, set up by the UN Charter in 1945, settles disputes between States and gives advisory opinions; the ICC, under the Rome Statute of 1998, tries individuals.
- The ICC is a court of last resort: under the Rome Statute, adopted on 17 July 1998, it complements national courts and does not replace them.
- The Human Rights Council has 47 member States, elected by the UN General Assembly for three-year terms; it replaced the Commission on Human Rights.
Practise a UPSC-style question
With reference to the UN Independent International Commission of Inquiry on the Occupied Palestinian Territory, consider the following statements:
1. It was set up by the UN Security Council to investigate violations in the Occupied Palestinian Territory.
2. Its October 2026 report to the General Assembly found that genocidal acts in Gaza continued after the October 2025 ceasefire.
3. It concluded that crimes against humanity, including extermination and torture, were committed in the West Bank.
Which of the statements given above is/are correct?
- (a) 1 and 2 only
- (b) 2 and 3 only
- (c) 1 and 3 only
- (d) 1, 2 and 3
Show the answer
Answer: (b) 2 and 3 only
Answer: (b) 2 and 3 only. The Commission works under a Human Rights Council mandate, not a Security Council one.
Statement 1: incorrect. The report was submitted under a resolution of the UN Human Rights Council, which created the Commission; the Security Council did not.
Statement 2: correct. Its fifth report to the General Assembly found that Israeli forces kept committing genocidal acts in Gaza after the October 2025 ceasefire.
Statement 3: correct. The Commission found the crimes against humanity of extermination, torture, rape and other sexual violence, and persecution in the West Bank.
Eliminate: statement 1 is wrong because the Commission is a Human Rights Council body. Out: (a), (c), (d).
Trap: Swapped attribution. The question pins the Commission on the Security Council, the UN organ students most link with wars, while its mandate comes from the Human Rights Council.
Remember: Country commissions of inquiry are set up by the Human Rights Council.
