MeitY urges social media platforms to curb manipulated, out-of-context content

MeitY on October 8, 2026 urged social media platforms to curb false, manipulated or out-of-context content, such as old photos and videos shown as current events. It said such posts can disturb public order and asked platforms to prioritise complaints from authorised government agencies. IT Rules already require takedowns within three hours of a court order or government notice.
Syllabus: GS2 · Constitution; GS2 · Governance & e-Governance; Prelims
Why it matters
A phone user who sees an old video of a street clash, forwarded as if it happened this morning, may panic, pass it on or join a crowd. The advisory asks platforms to catch such posts, not just AI deepfakes, and to act first on complaints from authorised agencies. That can make harmful fakes vanish faster. It can also make lawful posts disappear on an official flag that no court has examined: since the takedown window shrank to three hours, Meta has chosen to remove posts flagged through Section 79 notices automatically, drawing criticism from digital rights groups. The larger question is how to curb misinformation without chilling the free speech that Article 19 protects.
Prelims pointers
- Article 19(1)(a): freedom of speech and expression, for citizens only. Article 19(2): reasonable restrictions by law on eight grounds, including public order, defamation and contempt of court.
- Section 69A, IT Act, 2000: the Centre can block information on grounds such as sovereignty and integrity of India, security of the State and public order, giving written reasons.
- Section 79, IT Act: safe harbour. An intermediary is not liable for third-party content if it observes due diligence, but loses this protection if it abets an unlawful act.
- Shreya Singhal v. Union of India (2015): the Supreme Court struck down Section 66A, upheld Section 69A and the Blocking Rules, 2009, and read down Section 79.
- Blocking Rules, 2009: the intermediary and, if identified, the originator are heard before blocking; emergency blocking without a hearing must reach a committee within 48 hours.
- Intermediary (IT Act): anyone who receives, stores or transmits electronic records for others, including telecom and internet service providers, search engines, online marketplaces and cyber cafes.
- Right to Privacy: a Fundamental Right intrinsic to Article 21, held by a nine-judge Bench in K. S. Puttaswamy v. Union of India (2017).
- IT Rules, 2021: delegated legislation made by the Central Government under Section 87 of the IT Act, 2000; the 2026 amendments use the same power.
