Supreme Court: conversion to Islam brings no automatic backward-class reservation

The Supreme Court on 15 October 2026 upheld the Madras High Court's quashing of a Tamil Nadu order that let converts to Islam claim Backward Class Muslim status. The bench held that conversion by itself confers no membership of a notified backward community in the new faith.
Syllabus: GS2 · Constitution; Prelims · Polity & Governance; GS1 · Social Empowerment & Secularism
Why this matters for UPSC
GS2 polity: reservation under Article 15(4) and Article 16(4), and Scheduled Caste status under Article 341 and the 1950 Order. Prelims can ask these provisions and the National Commission for Backward Classes; Mains, whether caste disadvantage survives religious conversion.
Why it matters
For a person from a backward or Scheduled Caste family in Tamil Nadu who embraces Islam, the ruling closes a route the State had opened: a Backward Class Muslim community certificate on the strength of the old community. Without it, such a convert competes for government jobs and college seats outside that quota, unless backwardness can be shown afresh in the new community, a question the court left open. The ruling also limits governments: an executive order cannot extend backward-class benefits to converts by treating their pre-conversion community as continuing after a change of religion. It feeds the long debate over whether caste disadvantage follows people who leave Hinduism, which a Commission of Inquiry, its tenure last extended in April 2026, is examining for Scheduled Caste status.
Prelims pointers
- Article 15(4) was added by the Constitution (First Amendment) Act, 1951; Article 15(5) on admissions came with the 93rd Amendment, 2005.
- Article 16(4) permits reservation of posts for any backward class not adequately represented in services under the State; clause (4A) covers promotion for SCs and STs.
- Paragraph 3 of the 1950 Order: the Sikh religion was added by an Act of 1956 and the Buddhist religion by an Act of 1990.
- Article 342A(3), inserted by the 105th Amendment Act, 2021, lets every State keep its own list of socially and educationally backward classes.
- Article 338B, inserted by the 102nd Amendment Act, 2018, set up the National Commission for Backward Classes: a Chairperson, Vice-Chairperson and three other Members.
- Under Article 340, the President may appoint a Commission to investigate the conditions of socially and educationally backward classes.
- Article 366(24) defines Scheduled Castes by reference to Article 341; Article 366(26C) defines socially and educationally backward classes by reference to Article 342A.
- A Commission of Inquiry under the Commissions of Inquiry Act, 1952 (notified 6 October 2022, tenure last extended April 2026) is examining Scheduled Caste status for converts.
Practise a UPSC-style question
With reference to the Constitution (Scheduled Castes) Order, 1950, consider the following statements:
1. It provides that a person professing a religion other than Hinduism, Sikhism or Buddhism shall not be deemed a member of a Scheduled Caste.
2. Persons professing Buddhism were brought within its scope by an amendment made in 1956.
Which of the statements given above is/are correct?
- (a) 1 only
- (b) 2 only
- (c) Both 1 and 2
- (d) Neither 1 nor 2
Show the answer
Answer: (a) 1 only
Answer: (a) 1 only. Paragraph 3 of the Order names three religions, and Buddhism entered it in 1990, not 1956.
Statement 1: correct. Paragraph 3 of the Order, made by the President under Article 341, bars anyone professing a religion other than the Hindu, Sikh or Buddhist religion from being deemed a Scheduled Caste.
Statement 2: incorrect. The 1956 change (Act 63 of 1956) added the Sikh religion; the Buddhist religion was added by Act 15 of 1990.
Eliminate: Judge statement 1 first: it is the Order's best-known rule on religion, so it stands. Out: (b), (d).
Eliminate: Statement 2 pins the 1956 Sikh amendment on Buddhism, so it fails. Out: (c).
Trap: Near-miss figure. The year 1956 is a real amendment year for paragraph 3, so a student who remembers only the year attaches it to the wrong religion.
Remember: Paragraph 3: Sikhs added 1956, Buddhists 1990; Muslims and Christians stay outside it.
