State Public Service Commissions: Maharashtra sets up a paper-leak inquiry

On 11 October 2026 the Maharashtra government constituted a committee, chaired by a former judge of the Bombay High Court, to inquire into alleged question-paper leaks in the Maharashtra Public Service Commission (MPSC), review its functioning and recommend reforms within 60 days. The commission's chairman said he would stay on leave until the inquiry is complete.
Syllabus: Prelims · Polity & Governance; GS2 · Constitutional Bodies; GS2 · Governance & e-Governance
Why it matters
For an aspirant preparing for a State civil-service or clerical examination, a leaked paper can mean a cancelled test, another year of waiting and, for some, crossing the age limit. If a leak goes undetected, the people selected through it go on to staff offices that serve every citizen. The Constitution shields a State Public Service Commission from the government of the day: a fixed term, expenses that need no vote and removal only by the President. That shield guards honest recruitment from political pressure, but it also means a State that loses faith in its commission can investigate and reform it, not sack its head. The committee's 60-day report is where that reform must start.
Prelims pointers
- Article 315: a Public Service Commission for the Union and one for each State; two or more States may share a Joint State Public Service Commission.
- Joint State Public Service Commission: created by an Act of Parliament after the legislatures of the States concerned pass resolutions; the President appoints its members.
- Article 316: as nearly as may be, half of a commission's members must have held government office for at least ten years; no reappointment to the same office.
- Article 317(3): the President may remove a member for insolvency, paid work outside the office, or infirmity of mind or body, without a Supreme Court inquiry.
- Article 319: a former State PSC chairman may become chairman or member of the UPSC, or chairman of another State PSC, but is barred from other government employment.
- Articles 322 and 323: expenses charged on the Consolidated Fund of the State; the annual report goes to the Governor, who lays it before the State Legislature.
- UPSC and State PSC: UPSC members are appointed by the President and serve until 65; State PSC members by the Governor, until 62. The President removes both.
- Background: the Public Examinations (Prevention of Unfair Means) Act, 2024 covers examinations by UPSC, SSC, RRBs, IBPS and NTA, not State Public Service Commissions.

Answer: (c) Both 1 and 2
1 is correct: under Article 315(2), two or more States may agree to share a commission, and once each State's legislature passes a resolution, Parliament may provide for it by law, which makes it a statutory body. 2 is correct: Article 316(1) gives the President the power to appoint the members of a Joint commission, whereas the Governor appoints those of a State commission.
