Commerce and Industry Minister Piyush Goyal said on 15 October 2026 that the first tranche of the India-US Bilateral Trade Agreement has been finalised and is in legal drafting. India hopes to operationalise it once it gains a competitive advantage over peer countries, he said. Commerce Secretary Rajesh Agrawal said signing is tied to the new US tariff structure.

Syllabus: Prelims · Current Affairs & IR; GS2 · Groupings & Agreements; GS2 · Foreign Policies & the Diaspora

Why this matters for UPSC

GS2 bilateral agreements involving India and GS3 trade: Prelims can ask what GATT Article XXIV allows, how a free-trade area differs from a customs union, and India's agreements by partner; Mains, the India-US Bilateral Trade Agreement and WTO rules.

Why it matters

Take a garment or engineering exporter selling to American buyers. The exporter competes on price with suppliers from other countries. If the US charges Indian goods a lower duty than it charges those rivals, the Indian product becomes cheaper on American shelves, and orders, and the jobs behind them, can follow. That is why the Ministry ties the deal to an edge over peer countries: a tariff cut that every rival also gets changes little. A two-way deal also means India opens parts of its own market, which matters to domestic producers who would face new competition. Until the text is signed and operationalised, exporters keep planning around uncertain US tariffs.

Prelims pointers

  • GATT Article XXIV(8)(b): a free-trade area eliminates duties and restrictive regulations on substantially all trade in products originating in its members.
  • GATT Article XXIV(8)(a): a customs union goes further; its members apply substantially the same duties to trade with outsiders.
  • GATT Article XXIV(5)(c): an interim agreement leading to a free-trade area must include a plan and schedule to complete it within a reasonable length of time.
  • WTO's three sets of RTA rules: GATT Article XXIV (goods), the Enabling Clause (goods arrangements among developing country members) and GATS Article V (services).
  • Agreements under the Enabling Clause need not cover substantially all trade; agreements under Article XXIV must.
  • India's CEPAs (in force): UAE (1 May 2022), Republic of Korea (1 January 2010), Japan (1 August 2011), Oman (1 June 2026), per PIB, 28 July 2026.
  • Other Indian agreements by name: ECTA with Australia (29 December 2022), CECPA with Mauritius (1 April 2021), CETA with the UK (15 July 2026), per PIB.
  • India-EFTA TEPA, in force since 1 October 2025, covers Iceland, Liechtenstein, Norway and Switzerland, with an investment objective of USD 100 billion over 15 years.

Practise a UPSC-style question

With reference to regional trade agreements (RTAs) under the World Trade Organization (WTO), consider the following statements:

1. An RTA in WTO usage need not be between partners belonging to the same geographical region.

2. RTAs covering trade in services are governed by Article V of the General Agreement on Trade in Services.

Which of the statements given above is/are correct?

  1. (a) 1 only
  2. (b) 2 only
  3. (c) Both 1 and 2
  4. (d) Neither 1 nor 2
Show the answer

Answer: (c) Both 1 and 2

Answer: (c) Both 1 and 2. The WTO's RTA label turns on reciprocity, not geography, and services deals fall under GATS Article V.

Statement 1: correct. The WTO takes an RTA to mean any reciprocal trade agreement between two or more partners, not necessarily of the same region.

Statement 2: correct. The WTO's rules for agreements covering trade in services are set out in Article V of the GATS; goods deals fall under GATT Article XXIV.

Eliminate: Judge statement 1 first: the word 'regional' is a label, and India-US or India-EFTA deals count as RTAs. Out: (b), (d).

Eliminate: Statement 2 is also correct: services rules sit in GATS Article V. Out: (a).

Trap: Wrong scope. The word 'regional' tempts a student to think the partners must be neighbours, narrowing a definition that covers any reciprocal deal.

Remember: RTA in WTO terms = any reciprocal trade deal; goods under GATT Article XXIV, services under GATS Article V.
