Election Commission freezes Trinamool Congress name and symbol

The Election Commission of India froze the All India Trinamool Congress's name and its 'Flowers and Grass' symbol on September 17, 2026, ruling in a 14-page order that rival groups led by Mamata Banerjee and Arup Roy both claim the party and the dispute needs substantive determination. Both factions have been allotted new names and symbols pending the decision.

Why it matters
A voter in Nandigram or Rejinagar will not find the Flowers and Grass symbol on the voting machine on October 6. Candidates of the two groups must contest under their new names, with the Football Player or the Envelope beside them. Many voters know a party by its symbol, and those who cannot read depend on it. The interim order does not say which group is the real party. The ECI will decide that later under Paragraph 15, and the group it recognises as the party gets the old name and symbol. The Supreme Court noted in 2023 that if a symbol stays frozen for very long, voters may stop linking it with the party.
Prelims pointers
- Article 324: vests the superintendence, direction and control of elections to Parliament and State legislatures in the Election Commission of India.
- Election Symbols (Reservation and Allotment) Order, 1968: issued by the ECI, not Parliament, under Article 324 and the Conduct of Elections Rules, 1961.
- Paragraph 15 of the Symbols Order: the ECI may decide that one rival group, or none, is the recognised party; its decision binds all the groups.
- Sadiq Ali v. Election Commission of India (1971): the Supreme Court upheld Paragraph 15 and accepted the test of majority in the party's legislative and organisational wings.
- Subhash Desai (2023, the Shiv Sena case): the ECI may apply the test best suited to the case; the Speaker (Tenth Schedule) and the ECI (Paragraph 15) can decide concurrently.
- Section 29A of the Representation of the People Act, 1951: political parties register with the ECI; recognition as a National or State party comes under the Symbols Order.
- Reserved symbol: kept for the candidates of a recognised political party. Free symbol: any other symbol on the ECI's list, open to other candidates.

Answer: (c) 1 and 3 only
1 is correct: the ECI allotted new names and symbols to both groups until it decides the dispute. 2 is incorrect: neither group may use the party's name or its 'Flowers and Grass' symbol; both are frozen. 3 is correct: groups led by Mamata Banerjee and Arup Roy both claim to be the party, so the ECI held that the matter needs substantive determination.
